Be Lucky Tote Terms and Conditions


"BLT" is defined as Be Lucky Tote and the website www.beluckytote.com
"Player" is a person using or engaging in activity on BLT
"Parties" is BLT and the Player
"Service" is the provision of the BLT site and associated actions
"Event" is a betting event created by a Player
 
General
BLT is authorized to provide pool betting by the UK Gambling Commission under Operating License number 000-022706-R-305822-001
The Service must not be used by anyone under the age of 18 years
The Service is open to individuals only (this does not include a limited company, partnership or limited liability partnership)
The Service is governed by English Law and the BLT and the Player recognise that the County or High Courts of England shall have exclusive jurisdiction in the event of any dispute arising out of the Service or its administration
As a condition of using the Service a Player must ensure that, by doing so, he will not contravene any laws of his country of residence. BLT will not be liable in any way if a Player uses the Service unlawfully in the territory of the Player

Services
BLT provides an on-line pool betting service.
BLT will endeavor to provide the Service on a 24 x 7 basis and will take reasonable steps to ensure the uptime of the Service. BLT accepts no responsibility for loss of opportunity to bet or monies due to Service downtime
BLT will make reasonable endeavors to provide the Service with the reasonable skill and care of a competent electronic commerce service provider
Occasionally BLT may suspend the Service for operational reasons such as repair, maintenance or improvement of the Service or because of an emergency, but before doing so will give as much on-line, written or oral notice as is reasonably practicable.  BLT will restore the Service as soon as it reasonably can after suspension.


Crediting of accounts

Payment is accepted via on-line credit and debit card transaction, or a cheque drawn on a UK bank account. Player accounts will hold the full crediting value as virtual currency.
 
Payment for services
The value of the payout when a bet is finalised is subject to a deduction of a fifteen percent service charge, which covers BLT margin for operating the Service, UK betting tax, Player commissions, charitable donations, payment processing and all other fees in connection with providing the Service.

Payment from accounts

If the Player wishes to withdraw money from their on-line BLT virtual account, the on-line mechanism should be used to inform BLT of this intent.

BLT will make every reasonable effort to make prompt payment in the form of a cheque issued to the named Player and sent to the Player's BLT registered address. Payments may be paid to credit/debit cards, subject to the payment provider's terms and conditions. Such payment will be made within a reasonable time-frame and the Player should expect to receive payment within a period not exceeding 10 working days.
BLT cannot be held accountable for delays in the postal system or related logistical services of any kind.

Providing that the virtual account of a Player holds £20.00 (twenty pounds sterling) or more at the time of requesting a withdrawal, one free withdrawal is permitted per calendar month.  BLT reserves the right to levy a service charge not exceeding £2.00 (two pounds sterling) on subsequent withdrawals made in the same calendar month.

If a Player wishes to make a withdrawal from their virtual account having not made active use of the full,  original amount credited, BLT reserves the right to levy a 20% service charge on the requested withdrawal amount or £8.00 (eight pounds sterling), whichever is the greater.

If a player wishes to make a withdrawal from their virtual account while it holds less than £20.00 (ftwenty pounds sterling), BLT reserves the right to levy a 20% service charge on the requested withdrawal amount or £4.00 (four pounds sterling), whichever is the greater. 



Creating bets
Players receive 2% of the total pot size (at close of betting) of an Event.  This commission is credited to the virtual account of the Player immediately the bet outcome passes final validation.
BLT reserves the right to edit, amend, expand or reject an Event created by a Player before or after the Event is published to the BLT site.
BLT reserves the right to cancel an Event and refund any monies placed on the Event at any time prior to it passing final validation if in the opinion of BLT any suspicious circumstances become apparent in connection with any part of that Event or any players connected to that Event.  In these circumstances, no commission will be paid to the creator of the Event.
It is the responsibility of the Player to provide the results of the Event created by that Player in a timely and considered manner.  If the Player does not provide the result of the Event within 24 hours of the end of the Event, their commission on that Event reduces to 1% of the total pot size (at close of betting).

Placing money on a bet
It is the responsibility of the Player to satisfy himself/herself that the Event proposed, especially the creator’s validation method is acceptable to him/her.

Decision (sport bets)
The decision is that announced by the sport promoter's sanctioning officials at the Event, immediately after the Event has ended. BLT accepts no liability arising from any subsequent change in the decision.  As such, Events will not be re-opened at a later date, if a decision by a sport sanctioning body is changed after the close of an Event.

 
Decision (non-sport bets)

The decision is that given when the bet outcome passes final validation.  BLT accepts no liability arising from any subsequent change in the non-sport decision.


Disputes and complaints
Any dispute or claim, which cannot be resolved by our validation process will be passed to senior management for a decision. If the Player wishes to take the matter further, we will abide by the decision of IBAS (Independent Betting Arbitration Service), a service to which we subscribe, so long as the full facts have been submitted by both sides. However, if in the opinion of BLT, any suspicious circumstances become apparent in connection with any part of that Event or any Player connected to that Event, we reserve the right to make bets void or withhold payment pending the outcome of any investigation. No claims or disputes will be considered more than 7 days after the settlement date of the original transaction.


Security
The Player is responsible for the security and proper use of all user IDs and passwords used in connection with the Service and must take all necessary steps to ensure that they are kept confidential, secure, used properly and not disclosed to unauthorised persons.
The Player must immediately inform BLT if there is any reason to believe that a user ID or password has or is likely to become known to someone not authorised to use it, or is being, or is likely to be used in an unauthorised way.
BLT reserves the right to suspend user ID and password access to the Service if at any time BLT considers that there is or is likely to be a breach of security.
BLT reserves the right (at its sole discretion) to require the Player to change any or all of the passwords used by the Player in connection with the Service
The Player must immediately inform BLT of any changes to the information the Player supplied when registering for the Service.
 
Terms of service
The Player warrants that it will comply with all consumer and other legislation, instructions or guidelines issued by regulatory authorities, relevant licenses and any other codes of practice that apply to the Player.
The Service must not be used in a way that does not comply with the terms of any legislation or any license applicable to the Player or that is in any way unlawful.
The Service must not be used:

  • To send, receive, upload, download, use or re-use any information or material which is offensive, abusive, indecent, defamatory, obscene or menacing, or in breach of confidence, copyright, privacy or any other rights.
  • To cause annoyance, inconvenience or unnecessary anxiety.
  • To send or provide unsolicited advertising or promotional material or to receive responses to any unsolicited advertising or promotional material sent or provided using the Service by any third party.
  • Other than in accordance with the acceptable use policies of the Internet Standards.


BLT reserves the right to suspend or close the account of a Player deemed to be engaged in an activity, which in BLT's opinion is, or is likely to be, detrimental to the provision of the Service to the Player or any other Player.
A Player must indemnify BLT against any claims or legal proceedings, which are brought or threatened against BLT by a third party due to the actions of the Player.


Intellectual property rights
A Player must ensure that an Event does not infringe the copyright or other intellectual rights of any other person (individual or organization) and indemnifies BLT against any action taken as a result of any such infringement.
A Player must ensure that the marketing and promotion of an Event does not through links, adverts, banners, widgets or otherwise infringe the intellectual property rights of any other person (individual or organization) and indemnifies BLT against any action taken as a result of any such infringement.
Software, web based or otherwise used within the provision of the BLT service, is the property of BLT.
 
Terms infringements
BLT may suspend or close the account of a Player without notice if the Player or BLT, is the subject of a bankruptcy order, or becomes insolvent, or makes any arrangement or composition with or assignment for the benefit of their creditors.
Limitation of liability
BLT is not liable to Player either in contract, tort (including negligence) or otherwise for data manipulation, storage or processing errors, although BLT will take reasonable steps to correct any error at the earliest opportunity.
Each provision of these terms, excluding or limiting liability, operates separately. If any part is held by a court to be unreasonable or inapplicable, the other parts shall continue to apply.
 
Matters beyond reasonable control
If BLT is unable to perform any obligation under these terms because of a matter beyond its reasonable control such as lightning, flood, exceptionally severe weather, fire, explosion, war, civil disorder, industrial disputes (whether or not involving its employees), or acts of local or central Government or other competent authorities, or events beyond the reasonable control of its suppliers, it will have no liability to the other party for that failure to perform.
